1. Can foreign companies participate in Croatian public procurement without a local subsidiary?
Yes. Foreign economic operators from EU/EEA Member States and GPA signatory countries can bid directly on tenders in Croatia, either independently or in a consortium with local partners. We register your company in the EOJN RH portal, prepare your ESPD, and guide you on obtaining the exact criminal record, tax, and registry certificates recognized under Croatian procurement rules.
2. In what language must tenders be submitted in EOJN RH?
Under the Croatian Public Procurement Act, tenders and supporting documents are generally submitted in the Croatian language (unless the Contracting Authority explicitly allows parts of the technical documentation in English). We prepare all Croatian forms and coordinate certified translations of foreign certificates and technical datasheets where required.
3. How far in advance should we contact you before the tender submission deadline?
Ideally 5 to 10 business days before the deadline so we have time to submit formal clarification requests or challenge restrictive clauses in the Tender Documentation. However, for urgent cases we can also step in 2 to 3 business days prior to the deadline.
4. What if we do not meet all technical or financial references on our own?
Croatian procurement law (Art. 273 ZJN 2016) allows bidders to rely on the capacities of other entities (for economic/financial and technical/professional ability) or to submit a joint bid as a consortium. We draft all mandatory reliance declarations, resource agreements, and separate ESPD forms to ensure full compliance.
5. How does the appeal procedure before DKOM work and is the filing fee refunded?
Appeals are submitted electronically via the e-Appeal module in EOJN RH within 10 days of the publication of the Tender Documentation or receipt of the Award Decision. A timely appeal suspends contract signing. If DKOM upholds your appeal, the Contracting Authority is legally obligated to reimburse 100% of the statutory appeal fee you paid.
